DEAHANN HARRIS, INDIVIDUALLY, AND AS ADMINISTRATOR OF THE ESTATE OF RODNEY HARRIS, DECEASED, PLAINTIFF-RESPONDENT, v. ERIE COUNTY MEDICAL CENTER CORPORATION, DEFENDANT, RIFFAT SADIQ, M.D., JANICE M. VALENCOURT, RNFA, WNY MEDICAL, P.C., AND GERIATRIC ASSOCIATES, LLP, ALSO KNOWN AS ACUTE GERIATRIC SERVICES, DEFENDANTS-APPELLANTS.


PRESENT:

Appellant having moved to consolidate the appeals taken herein from an orders of the Supreme Court entered in the Office of the Clerk of the County of Erie on February 22, 2018 (appeal No. 1), and January 2, 2019 (appeal No. 2), and to adjourn oral argument of appeal No. 1,

Now, upon reading and filing the affirmation of Michael J. Willett, Esq., dated January 9, 2019, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to consolidate the appeals is denied, and

It is further ORDERED that the motion is granted to the extent that appeal No. 1 is removed from the Court's day calendar for January 16, 2019, and is added to the term of this Court commencing May 13, 2019, and

It is further ORDERED that appellant shall perfect appeal No. 2 on or before January 24, 2019, and in the event appeal No. 2 is so perfected by that date, appeal No. 2 is added to the term of this Court commencing May 13, 2019, to be heard with appeal No. 1.
