This case for the redetermination of a deficiency is before the Court on respondent's Motion to Dismiss for Lack of Prosecution, filed April 22, 2024, and heard on May 13, 2024, when the case was called from the calendar for trial in Houston, Texas. The parties appeared and advised the Court that they had reached a basis of settlement.

Premises considered, and for cause appearing more fully in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's motion is denied. It is further

ORDERED that a Proposed Stipulated Decision is due on or before June 12, 2024.
