This case is currently calendared for trial during the Court's January 30, 2023, Kansas City, Missouri, trial session. On October 11, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution (Doc. 10). By Order served October 13, 2022, among other things, respondent's motion was calendared for hearing during the Court's January 30, 2023, Kansas City, Missouri, trial session.

On November 16, 2022, the Court held a conference call with the parties to discuss the current status of the case and respondent's pending motion. During the call, petitioner provided the Court with her current mailing address. As discussed during the conference call and agreed to by the parties, the Court will deny respondent's motion to dismiss. Upon due consideration, it is hereby

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution filed October 11, 2022, is denied without prejudice. It is further

ORDERED that the hearing on the Motion to Dismiss for Lack of Prosecution is stricken from the Court's January 30, 2023, Kansas City, Missouri, trial session.

The parties are reminded that this case remains calendared for trial during the Court's January 30, 2023, Kansas City, Missouri, trial session scheduled to commence at 10:00 a.m. (Central Time).
