On September 7, 2023, we sent appellant notices that the filing fee and docketing statement were past due and directed him to pay the fee and file the docketing statement within ten days. Before the Court is appellant's September 21, 2023 motion to proceed without payment of costs. In his motion, appellant states that he filed a statement of inability to pay court costs in the trial court. We GRANT the motion. Because appellant filed a statement of inability to pay court costs in the trial court and the trial court has not ordered him to pay costs, he is allowed to proceed without payment of costs in this Court. See Tex. R. App. P. 20.2(b)(1).

Also before the Court is appellant's September 21, 2023 motion for an extension of time to file a docketing statement. Appellant filed the docketing statement on September 21, 2023. We GRANT the motion to the extent the docketing statement filed on September 21 is deemed timely filed.

The clerk's record has been filed and there is no reporter's record in this case. Accordingly, appellant shall file his opening brief on or before October 26, 2023.

We DIRECT the Clerk of this Court to send appellant a paper copy of the clerk's record.
