Harris County, Texas v. April Jones
189th District Court of Harris County Trial court case number: 2022-73839
MEMORANDUM ORDER
Peter Kelly, Judge
The clerk's record indicates that a flash drive, containing dashboard camera video from Deputy Christopher Sutton's vehicle, was attached to Harris County's Plea to the Jurisdiction as exhibit C.
On October 3, 2024, this Court issued an order directing the trial court clerk to prepare and certify a supplemental clerk's record including a copy of the dashboard camera video from Deputy Christopher Sutton's vehicle.
On October 4, 2024, the district clerk informed this Court that the supplemental clerk's record would not be filed because the clerk is "unable to locate [the] flash drive in the court at this time."
If a filing designated for inclusion in the clerk's record has been lost or destroyed, the parties may, by written stipulation, deliver a copy of that item to the trial court clerk for inclusion in the clerk's record or a supplement. Tex.R.App.P. 34.5(e). The district clerk has informed this Court that the clerk is currently "unable to locate" the flash drive with the dash camera video.
This appeal was submitted to this Court on September 18, 2024, and no opinion has yet issued. To facilitate timely disposition of this appeal, the parties are ordered to supplement the clerk's record by written stipulation, if at all, by delivering a copy of the dash camera video to the trial court clerk and request a supplemental clerk's record, if any, no later than October 28, 2024.
A supplemental clerk's record, if any, must be filed in this Court no later than November 4, 2024. Tex.R.App.P. 34.5(e). No costs shall be assessed for the supplemental record.
It is so ORDERED.
