This case is currently calendared for trial at the Session of the Court commencing on April 17, 2023, in Winston-Salem, North Carolina. On March 27, 2023, pursuant to the Court's Standing Pretrial Order served on the parties on December 22, 2022, the parties filed a Joint Status Report, apprising the Court of the then present status of this case. The parties report that on or around February 8, 2023, petitioners submitted to the Internal Revenue Service Independent Office of Appeals (Appeals) a Form 1040-X, Amended U.S. Individual Income Tax Return. The parties also report that Appeals then reached a settlement with petitioners based upon the Form 1040-X and concessions by both parties. The parties further report that (1) the Appeals officer requested a computation and sent a decision document to petitioners' counsel on or around March 9, 2023 and (2) on March 16, 2023, petitioners' counsel informed respondent's counsel that some of the numbers were incorrect in the computation. According to the parties, an updated computation was received late in the day on March 22, 2023, and is being reviewed by petitioners; the parties anticipate that a signed decision document will be received and filed by the April 17, 2023, Winston-Salem, North Carolina Trial Session. Upon due consideration, it is hereby
ORDERED that this case is stricken for trial from the April 17, 2023, Winston-Salem, North Carolina Trial Session of the Court. It is further
ORDERED that jurisdiction of this case is retained by this Division of the Court. It is further
ORDERED that the parties shall, on or before May 12, 2023, electronically submit to the Court an agreed stipulated decision document or file status reports, separately or jointly, apprising the Court of the then present status of this case.
