KATHY HARPST, STEPHANIE HARTFIELD, FREDIA RICE, JO'QUITA SANDERS, SHANNON MALM AND LAGEAN MEDEARIS, Appellant v. GEORGE FLEMING AND FLEMING & ASSOCIATES, L. L. P., Appellee
On Appeal from the 189th District Court Harris County, Texas
Trial Court Cause No. 2010-25097-A
ORDER
The reporter's record in this case was due April 17, 2017. See Tex. R. App. P. 35.1. On April 18, 2017, this court ordered the court reporter to file the record within 30 days. May 12, 2017 we received notice from Amanda King that payment arrangements had not been made for the record, and sent a no pay reporter's record notice to the appellant. On May 29, 2017 the appellant provided proof of payment for the record and we automatically gave a 30 day extension for the record to be filed. June 23, 2017 Ms. King filed another motion for extension of time to file the record which was granted until July 17, 2017 with the notation no further extensions. The record has not been filed with the court. Because the reporter's record has not been filed timely, we issue the following order.
We order Amanda King, the official court reporter, to file the record in this appeal within 30 days of the date of this order. No further extension will be entertained absent exceptional circumstances. The trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed. See Tex. R. App. P. 35.3(c). If Amanda King does not timely file the record as ordered, we may issue an order directing the trial court to conduct a hearing to determine the reason for the failure to file the record.
