Appeal, No. 82, April T., 1957, from judgment of County Court of Allegheny County, No. 1213 of 1955, in case of Mollie Harper, administratrix of the estate of Jesse Harper, deceased v. Leonard Gettleman, individually trading as Ford Construction Co. Judgment affirmed.

Trespass for deceit. Before McBRIDE, J.

Verdict for plaintiff; defendant's motions for judgment n.o.v. and for new trial refused and judgment entered on verdict. Defendant appealed.

Silvestri Silvestri, with him Stone Silvestri, for appellant. Charles E. McKissock, for appellee.


Argued November 13, 1957.


The six judges who heard the argument of this case being equally divided in opinion, the judgment of the court below is affirmed.
