Harper Construction, Inc. v. Grossman

Appellate Division of the Supreme Court of New York, Second Department
Sep 28, 1970
35 A.D.2d 673 (N.Y. App. Div. 1970)

Opinion

September 28, 1970

In an action to foreclose a mortgage on real property, defendants appeal from an order of the Supreme Court, Westchester County, dated October 10, 1969, which denied their motion to open their default in appearing and in serving a timely answer to the complaint. Order reversed, without costs, and motion granted. Defendants' time to serve their answer is extended until 20 days after entry of the order hereon. Appellants have shown excusable delay and a meritorious defense. Rabin, Acting P.J., Hopkins, Munder, Martuscello and Benjamin, JJ., concur.
