BY THE COURT:

It is ordered that the opinion filed herein on July 30, 2003 be modified as follows:

1. On page 14 of the opinion, in the third line of the second paragraph, "been narrowly defined:" is modified to read "been defined thusly:"

2. On page 14 of the opinion, the last sentence of the second paragraph is modified to read: "As appellant concedes in her briefs to this court, nothing resembling any of these issues was raised by respondents complaint."

The Application of California Bankers Association for Leave to File Amicus Curiae Petition for Rehearing to Request Modification of Opinion is granted. This modification does not effect a change in the judgment.
