Michael E. HARMS Appellant, (Cross-Appellee) v. Wayne BENKE Appellee, (Cross-Appellant)

From the County Court At Law No. 10, Bexar County, Texas
Trial Court No. 2016CV01012
Honorable David J. Rodriguez, Judge Presiding

ORDER

The court reporter has filed a letter regarding the record in which she states the cross-appellant has failed to pay or make arrangements to pay the fee for preparing the reporter's record and that cross-appellant is not entitled to appeal without paying the fee.

We, therefore, ORDER cross-appellant to provide written proof to this court by June 12, 2017 that either (1) the court reporter's fee has been paid or arrangements have been made to pay the court reporter's fee; or (2) cross-appellants are entitled to appeal without paying the court reporter's fee. If cross-appellant fails to respond within the time provided, the cross-appeal will be dismissed for want of prosecution. See TEX. R. APP. P. 37.3(b); see also TEX. R. APP. P. 42.3(c) (allowing dismissal of appeal if appellant fails to comply with an order of this court).
