Tenant appeals from an order of the Civil Court of the City of New York, New York County (Brenda S. Spears, J.), entered September 23, 2009, which granted landlord's motion for entry of a final judgment in a nonpayment summary proceeding.

Order (Brenda S. Spears, J.), entered September 23, 2009, affirmed, without costs.

PRESENT: McKeon, P.J., Shulman, Hunter, JJ.


Civil Court properly granted petitioner-landlord's motion seeking entry of a final judgment, since tenant failed to comply with the unambiguous payment terms of the governing stipulation settling this nonpayment summary proceeding ( see Chelsea 19 Assoc. v James, 67 AD3d 601).

THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
