Decided May 2d 1935.

Injunction — Premature Suit

A bill by employees of several retail stores, to restrain the defendants from demanding plaintiffs' discharge from their employment for racial reasons, held to have been prematurely filed, since plaintiffs knew that their employers had determined to resist defendants' demands, and that hence plaintiffs' rights and employment were not jeopardized.

Decided May 2d 1935.

Appeal from the Circuit Court of Baltimore City (OWENS, J.).

Bill by Billie Ethel Hark, a minor, by Sarah Weiss, her sister and next friend, and others, against Tony Green, alias Kiowa Costonie, and others. From a decree dissolving a preliminary injunction and dismissing the bill, plaintiffs appeal. Affirmed.

The cause was argued before BOND, C.J., OFFUTT, PARKE, SLOAN, SHEHAN, and JOHNSON, JJ.
