NATHAN HARDIN, Petitioner and Appellant, v. STATE OF MONTANA, Respondent and Appellee

ORDER

On April 10,2024, self-represented Appellant Nathan Hardin filed his opening brief in this appeal. On April 26, 2024, he filed a motion to supplement his opening brief, where he states that his motion is unopposed. His supplemental brief puts forth an argument based on the Full Faith and Credit provision. U.S. Const., art. IV, § 1.

Pursuant to the Montana Rules of Appellate Procedure, "[m]otions to file overlength and supplemental briefs will not be routinely granted." M. R. App. P. 12(10). This rule also requires that a motion to file a supplemental brief '"must be supported by an affidavit demonstrating extraordinary justification." M. R. App. P. 12(10).

Upon review, we observe that while Fiardin has not demonstrated extraordinary justification nor an affidavit, he has submitted a relatively short and unopposed supplemental brief. Therefore, IT IS ORDERED that Hardin's Motion for to Supplement his Opening Brief is GRANTED. The Clerk is directed to file his supplement brief as of this date.

The Clerk is also directed to provide a copy of this Order to counsel of record and to Nathan Hardin personally.
