DONALD EVERETTE HARDGE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 1 Dallas County, Texas Trial Court Cause No. F17-75493-H

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

Donald Everette Hardge was convicted by a jury of capital murder and sentenced to life without parole. On June 6, 2022, the 573-page clerk's record was filed. The record does not contain the March 28 agreed order of the parties, the jury charge, the verdict, or the judgment. In addition, the cover sheet of the clerk's record does not identify the trial court, the appellate number, or the name of the clerk prepared the record, and the index does not identify certain documents such as the trial court's docket sheet. See Tex. R. App. P. 34.5(a)(2)-(5); app. C. (providing the proper format for the clerk's record). We STRIKE the clerk's record.

This list is not intended to be comprehensive. Other documents essential to the appeal may be missing.

We ORDER Dallas County District Clerk Felicia Pitre to file a corrected clerk's record that complies with the Texas Rules of Appellate Procedure WITHIN TEN DAYS OF THE DATE OF THIS ORDER.

The Clerk is DIRECTED to send copies of this order to Dallas County District Clerk Felicia Pitre; Christina O'Neill, Chief Judicial Staff Counsel; and counsel for all parties.
