MEMORANDUM OPINION


The Court has before it appellant's and appellee's July 23, 2008 joint motion to dismiss this appeal. The parties advise they have reached an agreement to settle and compromise their differences in this matter.

We GRANT the joint motion and DISMISS this appeal. See Tex. R. App. P. 42.1(a)(2). In conformity with the parties' agreement, it is ORDERED that each party bear its own costs of this appeal.
