This case is on the Court's March 21, 2022 trial calendar for Saint Paul, Minnesota. Believing that settlement of this case was very likely, respondent filed a status report on February 28, 2022 in lieu of a pretrial memorandum. Although the parties are still working towards settlement, in the event settlement should fail to materialize, respondent respectfully requests the opportunity to provide the Court with information and argument regarding the matters at issue in this case via a pretrial memorandum. It is therefore

ORDERED that petitioner's Motion for Leave to File Out of Time Pretrial Memorandum is granted. The pretrial memorandum lodged with the motion shall be filed.
