ORDER


Plaintiff Edna Hansen filed a Complaint in the Third District Court, in and for Salt Lake County, State of Utah ("State Court"), on April 3, 2003. (See Compl., attached as Ex. to Notice of Removal.) On April 29, 2003, Defendant Holladay Healthcare Center ("Holladay") filed a Notice of Removal pursuant to 28 U.S.C. § 1446(2002).

Holladay contends that complete diversity of jurisdiction exists between the parties and therefore that the court has subject matter jurisdiction under 28 U.S.C. § 1332. Holladay, however, has not claimed that the amount in controversy in this case exceeds $75,000. See 28 U.S.C. § 1332(a). Further, the allegations contained in the Complaint do not clearly indicate that the amount in controversy exceeds $75,000. Consequently, Holladay has ten days from the date of this Order to show cause as to why the court should not remand this case to State Court for lack of subject matter jurisdiction pursuant to 28 U.S.C. § 1447(c).

IT IS SO ORDERED.
