Order, so far as appealed from, granting defendant's motion to strike out parts of the first cause of action in the second amended complaint unanimously affirmed, with twenty dollars costs and disbursements, with leave to the plaintiff to serve a further amended complaint within ten days after service of order with notice of entry, upon payment of said costs. No opinion.
