The order appealed from should be modified so as to vacate both judgments and direct the clerk to enter a judgment in plaintiff's favor for $250, with costs, as heretofore taxed, and as so modified affirmed, without costs.


Order modified as stated in opinion, and as so modified affirmed, without costs. Order to be settled on notice.
