MOTION DECISION

Present - Hon. Cynthia S. Kern, Barbara R. Kapnick Ellen Gesmer Tanya R. Kennedy Kelly O'Neill Levy, Justice Presiding, Justices.

Appeals having been taken to this Court from an order of the Family Court, New York County, entered on or about December 13, 2023 (Case No. 2024-00090) and from an order, same Court, entered on or about September 4, 2024 (Case No. 2024-06023), And respondent-appellant, pro se, having moved for an extension of time to perfect the appeal taken to this Court under Case No. 2024-00090, consolidation of the aforesaid appeals, poor person relief, and related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of extending the time to perfect the appeal under Case No. 2023-00090 to the June 2025 Term of this Court; to the extent that the motion seeks to consolidate the aforesaid appeals, such relief is denied as unnecessary, as the appeals may be consolidated as of right (See, 22 NYCRR 1250.9[f][3]); and

It is further ordered that the branch of motion seeking poor person relief is denied, with leave to renew, upon an affidavit pursuant to CPLR 1101(a) and 22 NYCRR 22 and NYCRR 12504(d), setting forth the value of any real and personal property owned by respondent-appellant, the source of funds used to retain counsel to perfect his appeal under Case No. 2023-02647, and an explanation as to why such funds are not available to prosecute this appeal.
