This matter came on before the Court on defendants' motion for sanctions under Fed.R.Civ.P. 11 and motion for summary judgment dismissing plaintiffs complaint with prejudice on the grounds that no reasonable jury, properly instructed, could find the copyrightable elements in defendant's book to be substantially similar to plaintiffs book, and the Court having, on May 7, 2000, made an opinion and order granting said motion for summary judgment and dismissing said motion for sanctions, it is hereby

ORDERED, ADJUDGED AND DECREED that plaintiffs complaint, and each claim asserted therein be, and hereby are, dismissed on the merits and with prejudice, and that defendant's motion for sanctions is denied.
