WADE E. HAMPTON, JR., Respondent Below-Appellant, v. SYREETA H. SMITH, Petitioner Below-Appellee. No. 64, 2003. Supreme Court of Delaware. April 9, 2003.

Carolyn Berger, Justice

ORDER

This 9th day of April 2003, it appears to the Court that on February 13, 2003, the Clerk issued a notice to show cause why this appeal should not be dismissed pursuant to Supreme Court Rule 29(b) for the appellant's failure to comply with Supreme Court Rule 42 when taking an appeal from an apparent interlocutory order. The appellant has failed to respond to the notice to show cause within the required 10-day period; therefore, dismissal of this action is deemed to be unopposed.

NOW, THEREFORE, IT IS ORDERED that, pursuant to Supreme Court Rules 3(b) and 29(b), the within appeal is DISMISSED.
