ORDER

DANIEL A. GUY, JR. SPECIAL TRIAL JUDGE

This case is set for trial at the Court's September 13, 2021, Los Angeles, California remote trial session. On July 28, 2021, respondent filed a motion to dismiss for lack of prosecution. On August 17, 2021, a telephone conference call was held with the parties. During the call, the parties informed the Court that they have arrived at a basis for settlement.

Upon due consideration, it is

ORDERED that the Court's Order dated July 30, 2021, directing petitioner to file an objection, if any, to respondent's motion to dismiss for lack of prosecution is vacated and set aside. It is further

ORDERED that respondent's motion to dismiss for lack of prosecution is denied. It is further

ORDERED that this case is stricken for trial from the September 13, 2021, Los Angeles, California trial session. It is further

ORDERED that, on or before September 16, 2021, the parties shall file a proposed stipulated decision or respondent shall file a status report. It is further

ORDERED that jurisdiction over this case is retained by the undersigned.
