Georgetown, Delaware 19947 Upon Plaintiff's Motion to Modify Scheduling Order to Allow Additional Time to Answer. Granted. Dear Parties:
On October 20, 2016 Plaintiff Nancy Hammer ("Hammer") filed a Motion for Extension of Time. She requests additional time to respond to Defendants' Howard Medical, Inc. and Howard Industries, Inc. ("Howard") Motion for Summary Judgment. Her response would have been due on October 31, 2016, but on that date Hammer had yet to receive documents from Howard that may be helpful to address Howard's Motion. All of the documents have been supplied to Hammer by supplementary filings by Howard in December.
Consequently, the Scheduling Order is modified as follows:
(1) Hammer's answering brief to Howard's Motion for Summary Judgment shall be filed on or before March 3, 2017;
(2) Howard shall file a reply on or before March 13, 2017. As previously addressed, Hammer is not to file a reply to a reply.
(3) Howard has filed its answering brief in opposition to Hammer's Motion to Dismiss; Hammer shall file the reply on or before March 3, 2017.
Considering the foregoing, Plaintiff's Motion for Extension of Time is GRANTED , good cause having been shown.
