This case is calendared for a remote trial at the session of the Court scheduled to commence on February 27, 2023, for cases in which Portland, Oregon, is listed as the place of trial

On November 8, 2022, respondent filed a motion to dismiss for failure to state a claim upon which relief can be granted (respondent's motion). On November 10, 2022, the Court issued an order directing petitioner to file on or before January 11, 2023, a response to respondent's motion. Petitioner did not file any such response.

On January 27, 2023, respondent filed a status report.

Upon due consideration of the foregoing, it is

ORDERED that respondent's motion to dismiss for failure to state a claim upon which relief can be granted filed November 8, 2022, is set for remote hearing on Monday, February 27, 2023, at 10:00 a.m. (PST) (1:00 p.m. EST). Petitioner is advised that failure to comply with this order or failure to appear at the remote hearing on February 27, 2023, may result in the Court granting respondent's motion. It is further

ORDERED that the Clerk of the Court is directed to attach to this order a copy of the notice setting case for trial that was previously issued in this case on October 27, 2022.

This order constitutes official notice to the parties.
