Appellate Division of the Supreme Court of New York, Second Department
Dec 19, 1949
276 App. Div. 863 (N.Y. App. Div. 1949)

Opinion

December 19, 1949.

Action for an equitable accounting. Order denying motion to dismiss the complaint for insufficiency affirmed, with $10 costs and disbursements, with leave to defendants to answer within ten days from the entry of the order hereon. The allegations in the complaint sufficiently allege that the individual defendants have kept moneys belonging to the membership corporation of which they are officers and trustees. Carswell, Acting P.J., Johnston, Adel, Wenzel and MacCrate, JJ., concur.
