ORDER MODIFYING OPINION

THE COURT:

IT IS ORDERED that the opinion filed in the above-captioned matter on June 1, 2011, be modified as follows:

On page 3, in the first sentence of the second full paragraph, the words “In March 2008” are deleted and replaced with the words “After the loan was transferred.”

The second sentence of the Disposition is revised to read as follows:

“Greenwich Investors shall recover its costs on appeal.”

There is a change in the judgment.
