ORDER


For the reasons set forth at the close of the December 8, 2003 hearing on plaintiff's' Motion for Partial Summary Judgment and Defendant's Motion for Summary Judgment, the court orders as follows. Plaintiff's Motion for Partial Summary Judgment is DENIED. Defendant's Motion for Summary Judgment is GRANTED only as to plaintiff's' cause of action for Dispossession and Trespass to Chattels, and DENIED as to the remainder.

IT IS SO ORDERED.
