ORDER MODIFYING OPINION NO CHANGE IN JUDGMENT

RYLAARSDAM, J.

It is ordered that the opinion filed herein on June 1, 2007, be modified in the following particulars only:

1. On page 13, in the second full paragraph on line three starting with “inadmissible evidence,” delete “(People v. Sturm, supra, 37 Cal.App.4th at p. 1240.)” and replace it with

“(People v. Sturm, supra, 37 Cal.4th at p. 1240.)”

2. On page 13, in the second full paragraph on line seven starting with “the competence, honesty,” delete the entire quote starting with “Where the trial court,” and replace it with:

“The trial court’s comment implying that . . . counsel was behaving unethicvally or in an underhanded fashion constituted misconduct.”

These modifications do not change the judgment.
