Halstead v. Westchester Electric Railroad Company

Appellate Division of the Supreme Court of New York, Second Department
Jan 1, 1923
205 App. Div. 853 (N.Y. App. Div. 1923)

Opinion

January, 1923.

Judgment and order reversed on the law and the facts, and a new trial granted, costs to abide the event, because of the error appearing in the charge of the trial court at folios 645 and 646, and also because the finding that the motorman was guilty of willful and wanton recklessness was against the weight of the evidence. Rich, Kelly, Jaycox, Manning and Kelby, JJ., concur.
