ORDER OF DISMISSAL

This case is calendared for trial on the Court's December 13, 2021, Jacksonville, Florida remote trial session. On September 13, 2021, petitioner, through its counsel, filed a motion to dismiss pursuant to Wagner v. Commissioner, 118 T.C. 330 (2002). The motions states that respondent is not opposed to the granting motion.

Upon due consideration and for cause, it is

ORDERED that this case is stricken for trial from the Court's December 13, 2021, Jacksonville, Florida remote trial session. It is further

ORDERED that petitioner's motion to dismiss filed September 13, 2021, is granted, and this case is dismissed.
