Halliday v. Apfel

United States District Court, D. Oregon
Dec 19, 2000
Civil No. 99-1592-HA (D. Or. Dec. 19, 2000)

Opinion

Civil No. 99-1592-HA

December 19, 2000

OPINION AND ORDER

Plaintiff moves for an award of attorney fees totaling $621.97 and costs totaling $160.26 under the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412. Defendant has not filed an objection to this request, and therefore, the fees issues under EAJA, including plaintiff's designation as a prevailing party, plaintiff's net worth qualifications, and whether the defendant's position was substantially justified, are all undisputed.

This court has reviewed plaintiff's application. The court concludes that plaintiff is the prevailing party, counsel's application is reasonable, and plaintiff's request for fees totaling $621.97 and costs totaling $160.26, (doc. 12), is granted as presented in plaintiff's motion and supporting affidavit. Any other pending motions are denied as moot. This case remains closed.

IT IS SO ORDERED.
