Court of Appeals of Texas, Fifth District, Dallas
Oct 18, 2005
No. 05-05-01409-CV (Tex. App. Oct. 18, 2005)

Opinion

No. 05-05-01409-CV

Opinion issued October 18, 2005.

Original Proceeding from the 44th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 05-9782-B.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

Opinion By Justice O'NEILL.

MEMORANDUM OPINION

Before us is relator's petition for writ of mandamus in which it contends the trial judge erred in dissolving the temporary restraining order and refusing to consider his application for temporary injunction. The record before us contains the trial judge's facsimile transmission notifying the parties of his intended ruling, but it does not contain a written order. Accordingly, relator's petition for writ of mandamus and request for temporary relief are denied. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus.
