Opinion

No. 285, 2007.

Submitted: August 21, 2008.

Decided: September 9, 2008.

Court Below — Superior Court of the State of Delaware, in and for Kent County, Cr. ID Nos. 0602012587.

ORDER

This 9th day of September 2008, the Court has considered appellant's motion to remand and the State's response thereto. This direct criminal appeal was filed in June 2007. After the Court permitted trial counsel to withdraw his representation on appeal, Hall's substitute counsel filed a motion requesting a remand for an evidentiary hearing regarding trial counsel's effectiveness and the appropriateness of Hall's sentence. Ineffectiveness claims ordinarily are not considered on direct appeal. Accordingly, we find no good cause to remand this case.

Desmond v. State, 654 A.2d 821, 829 (Del. 1994).

NOW, THEREFORE, IT IS ORDERED that the motion to remand is DENIED.
