ORDER


On October 9, 2002, the Court issued an Order to Show Cause directing Defendants to respond to outstanding court orders regarding the provision of a sworn statement regarding the disposition of certain of Plaintiff's property and to provide Plaintiff with copies of certain documents, and directing Defendants to show cause as to why they should not be compelled to respond to certain outstanding discovery requests.

The Court received the statements regarding property disposition on October 11, 2002, and has received a response, dated October 21, 2002, addressing the discovery issues. The latter statement represents that Defendants' responses to Plaintiff's First Set of Interrogatories and Request for Documents were served on October 21, 2002.

In light of the foregoing, the Order to Show Cause is withdrawn.

Defendants' counsel is, however, hereby directed to prepare and serve upon Plaintiff, with a copy to the Court, a list of the copies of court documents she contends have been provided to Plaintiff in accordance with the Court's order. A copy of Plaintiff's October 21, 2002 letter, alleging that he has not received copies of the file documents, is attached.

As to Defendants' request to move to dismiss, Defendants' counsel's attention is directed to the Individual Practices Rules of the undersigned for relevant procedural information.

IT IS SO ORDERED.
