          ORDER ACCEPTING MAGISTRATE JUDGE'S FINAL REPORT AND RECOMMENDATION

          HONORABLE JAMES V. SELNA, UNITED STATES DISTRICT JUDGE.

         Pursuant to 28 U.S.C. § 636, the Court has reviewed the Petition, the other records on file herein, petitioner's November 20, 2014, letter to the Court, and the magistrate judge's final report and recommendation. The Court accepts the final recommendations of the magistrate judge.

         ACCORDINGLY, IT IS ORDERED:

1. The final report and recommendation is accepted. 2. Judgment shall be entered consistent with this order.

3. The clerk shall serve this order and the judgment on all counsel or parties of record.

         JUDGMENT

         Pursuant to the order adopting the magistrate judge's final report and recommendation, IT IS ADJUDGED that the petition in this matter is denied and dismissed without prejudice.
