Hall v. Gerken

Appellate Division of the Supreme Court of New York, First Department
Jul 1, 1904
96 App. Div. 632 (N.Y. App. Div. 1904)

Opinion

July Term, 1904.

Present — Van Brunt, P.J., Patterson, O'Brien, McLaughlin and Hatch, JJ.

Order modified as stated in opinion, and as modified affirmed, without costs.

The order in this case is too broad and requires particulars to be stated with which the defendant evidently cannot make compliance. The order should be modified by requiring the defendant to state between what dates he suffered loss of profits by reason of the plaintiff's acts and the aggregate amount thereof, and as so modified the order should be affirmed, without costs to either party in this court.
