ORDER

Maurice B. Foley, Chief Judge

On July 29, 2021, respondent filed a Motion to Dismiss for Lack of Jurisdiction. By Order issued August 24, 2021, the Court directed petitioner to file an objection, if any, to respondent's motion to dismiss. After having not received any response from petitioner, by Order of Dismissal for Lack of Jurisdiction, entered October 19, 2021, this case was dismissed for lack of jurisdiction. Subsequently, an objection from petitioner was processed and filed as of September 29, 2021. We will, therefore, vacate the previously entered Order of Dismissal for Lack of Jurisdiction so that petitioner's objection to respondent's motion to dismiss may be considered.

In view of the foregoing, it is

ORDERED that the Court's Order of Dismissal for Lack of Jurisdiction, entered October 19, 2021, is vacated and set aside.
