DECISION & ORDER ON MOTION
Motion by the appellant to stay the petitioner-respondent, among others, from causing certain election ballots to be printed pending hearing and determination of an appeal from an order of the Supreme Court, Dutchess County, dated October 7, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied as academic in light of the determination of the appeal (see Matter of Haight v Knapp , ___ AD3d ___ [2d Dept, Oct. 24, 2011].
