PRESENT:

Appellant having moved for permission to proceed as a poor person on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on December 12, 2018,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed with leave to renew upon making a new motion for permission to proceed as a poor person that includes a motion to vacate dismissal of the proceeding (see 22 NYCRR 1250.10 [c]).
