PRESENT:

Plaintiff having moved for an extension of time to perfect the cross appeal (denominated a motion to vacate dismissal of the cross appeal) taken herein from an order of the Supreme Court, Erie County, entered December 3, 2019, and for other relief,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted insofar as it seeks an extension of time to perfect the cross appeal, on the condition that plaintiff files and serves a supplemental brief with a red cover addressing the cross appeal on or before July 10, 2020.
