Judgment reversed upon the law and the facts, and new trial granted, costs to appellant to abide the event. Plaintiff's proof presented questions of fact which should have been submitted to the jury. Lazansky, P.J., Young, Kapper, Hagarty and Carswell, JJ., concur.
