Upon consideration of the record and briefs of counsel for the respective parties, we determine the only error of the trial court was in directing partition of the real property not sold within ninety (90) days without proper pleadings as required by Chapter 64, Florida Statutes. Accordingly, the order is reversed and the cause remanded for further proceedings consistent with the views herein expressed.

Reversed and remanded.
