Guttenberg v. Sch. Bd. of Broward Cnty.

1 Citing case

  1. Tony v. Evanston Ins. Co.

    674 F. Supp. 3d 1226 (S.D. Fla. 2023)

On those facts, the court held that each instance of abuse during that year-plus period was a separate occurrence subject to a separate SIR. S. Cent. Educ. Risk Mgmt. Program, 2018 WL 11353289, at *9. The Court's conclusion in this case that it reasonable to interpret the facts of the Parkland Shooting Incident as a single "occurrence" under the Policy is further supported by the Florida Supreme Court's sovereign immunity decisions in Barnett v. Dep't of Fin. Services, 303 So. 3d 508 (Fla. 2020) and Guttenberg v. School Bd. of Broward Cnty., 303 So. 3d 518 (Fla. 2020) -- which arose from Parkland Shooting Incident. Barnett v. Dep't of Fin. Services, 303 So. 3d 508 (Fla. 2020), involved a situation in which a man fatally shot his estranged wife and four of her children, and severely wounded a fifth child.
