a false statement of material fact made to induce the plaintiff to act, together with reliance on the false statement by the plaintiff to the plaintiff's detriment. Gura v. Dias, 74 Mass.App.Ct. 1106, 904 N.E.2d 494, at *1 (Table) (Mass.App.Ct.2009) (quoting Zimmerman v. Kent, 31 Mass.App.Ct. 72, 575 N.E.2d 70 (1991)). Comverse has provided the Court with ample documentation evidencing that the ten-year expiration period was repeatedly and clearly communicated to employees who received stock option grants.
