Tana Gunville and Tom Gunville, Appellants, v. Shelby Gonzales and Guadalupe Gonzales, Appellees.
Appeal from the
394th District Court
of Brewster County, Texas
(TC# 2010-11-B0072)
ORDER
The Brewster County District Clerk has submitted a paper version of the clerk's record for filing in the above-styled and numbered cause, but has not submitted a motion or letter establishing good cause for not e-filing the clerk's record. The Clerk's Office has made several attempts to communicate with the District Clerk about the clerk's record but has been unsuccessful.
The Court has reviewed the record and has determined it cannot be filed because: (1) it has not been electronically filed; (2) it does not contain the notice of appeal; (3) it does not contain all of the materials designated by Appellants in the written designation, including the order granting the motion for summary judgment; and (4) the District Clerk did not sign the bill of cost or the certification. Therefore, the Clerk's Record, 2 volumes received in this office on March 11, 2014 are being returned to the Brewster County District Clerk's Office. The Brewster County District Clerk is directed to prepare the clerk's record and file it electronically in accordance with the Texas Rules of Appellate Procedure no later than April 9, 2014.
IT IS SO ORDERED this 18th day of March, 2014.
PER CURIAM Before McClure, C.J., Rivera and Rodriguez, JJ.
