Gunther v. Gunther

Supreme Court of Florida. En Banc
Apr 18, 1956
86 So. 2d 888 (Fla. 1956)

Opinion

April 18, 1956.

Appeal from Circuit Court, Dade County; Robert L. Floyd, Judge.

Jeptha P. Marchant and Joseph A. Perkins, Miami, for appellant.

O.B. White, Miami, for appellees.

The sole question presented in this appeal is whether the complaint for divorce contains equity. We are of the view that the allegations contained in the complaint are sufficient to withstand a motion to dismiss. The decree appealed from is, therefore, reversed with directions to reinstate the cause and for further appropriate proceedings.

TERRELL, THOMAS, ROBERTS, THORNAL and O'CONNELL, JJ., concur.

SEBRING, J., dissents.
