FINAL JUDGMENT
This matter came before the Court for a jury trial as to plaintiffs claims for breach of contract, the issues having been duly tried and the jury having duly rendered its verdict, it is hereby ORDERED, ADJUDGED and DECREED that the plaintiff, Gulf Bridge Ro/Ro, L.L.C., shall recover of the defendant Ford Motor Company, Inc., damages in the total amount of one million three hundred twenty-two thousand four hundred twenty-two and no/100ths ($1,322,422.00) dollars. Costs shall be taxed in accordance with 28 U.S.C. § 1920 and Local Rule 54.1.
The Court previously granted defendant's motion for summary judgment as to plaintiffs claims for fraud, promissory fraud and fraudulent suppression.
ORDER
The above-styled case came on for trial by jury on September 11, 2000, with the Honorable Charles R. Butler, Jr., Chief U.S. District Judge presiding. The jury was selected, but not sworn on September 6, 2000.
On September 11, 2000, the jury was duly sworn and trial began. The plaintiff presented its case on September 11, 12, and 13 and rested. The defendant filed a Motion for Judgment as a matter of law at the conclusion of the plaintiff's case. The Court made an oral ruling and DENIED the defendant's motion. The Court held a charge conference with counsel.
Court reconvened, and the defendant presented its case and rested on September 14, 2000. At the close of the evidence, Ford Motor Company renewed its motion for judgment as a matter of law. The Court made an oral ruling and DENIED the motion. The respective parties gave their closing arguments to the jury. On September 14, 1999, the Court charged the jury on the applicable law and the jury commenced their deliberations.
On September 14, 2000, the jury, having considered the evidence and the Court's instructions on the law governing the facts in this case, returned a verdict in favor of the plaintiff (a copy of which is attached hereto). The plaintiff Gulf Bridge Ro/Ro is awarded the amount of $937,302.00 in damages as a result of Ford's breach of the minimum volume agreement, and $385,120.00 in damages as a result of Ford's breach of the notice-of-termination agreement, for a total amount of $1,322,422.00. The Clerk of Court is directed to terminate this case from the Court's active docket.
