ASSIGNMENTS, § 16 — equitable, agreement to, pay out of particular fund. In action to recover on alleged equitable assignment of proceeds of insurance policies, of which defendant was beneficiary, where defendant testified that she received much more money from plaintiff than was evidenced by the notes, and that she had lived with plaintiff as his mistress, at most the evidence showed that defendant agreed to pay her debt out of a designated fund, which would not constitute an equitable assignment.

Appeal from Circuit Court of Cook county; Hon. CORNELIUS J. HARRINGTON, presiding.
Reversed and remanded. Heard in first division, first district, this court at October term, 1939.
